These Terms of Use govern access to and use of gladius.so. By using the website, you agree to these terms. If you do not agree, do not use the website.
Eligibility and business use
You must have the legal capacity to agree to these terms. If you use the website on behalf of a business or other organization, you represent that you have authority to act for it. The website is intended primarily for businesses and professionals exploring conversion strategy, design, and implementation services.
Website information
The website provides general information about Gladius and a way to request a conversion strategy call. Website content is informational and may be changed, corrected, or removed at any time. It is not legal, financial, accounting, or other regulated professional advice.
No client relationship
Booking or attending a call does not create a client relationship, fiduciary relationship, partnership, agency, or obligation for Gladius to provide services. A client relationship begins only when the appropriate parties sign a separate written services agreement or statement of work.
Service engagements
Any project, retainer, deliverable, fee, payment term, performance standard, data-access requirement, confidentiality obligation, intellectual-property allocation, warranty, or remedy will be governed by a separately signed agreement. If a signed agreement conflicts with these website terms, the signed agreement controls for that engagement.
No guarantees
Examples of strategy, design, testing, implementation, or potential improvement are not promises of a particular conversion rate, revenue result, ranking, or business outcome. Results depend on many factors outside Gladius's control, including traffic quality, offer, product, pricing, inventory, customer demand, implementation, and measurement conditions.
Acceptable use
You may not use the website to violate law; infringe intellectual property or privacy rights; transmit malicious code; probe, scan, disrupt, or circumvent security; scrape or copy the website through automated means except as permitted by law or standard search indexing; impersonate another person; submit false or harmful information; or interfere with another person's use of the website.
Intellectual property
The website, including its design, text, graphics, visual systems, code, trademarks, and other content, is owned by Gladius or its licensors and is protected by applicable law. Gladius grants you a limited, revocable, non-exclusive right to access the website for its intended purpose. No other license is granted. You may not reproduce, distribute, modify, create derivative works from, publicly display, sell, or exploit website content without prior written permission, except where applicable law permits.
Feedback
If you voluntarily provide suggestions or feedback about the website or Gladius services, you grant Gladius a worldwide, perpetual, irrevocable, royalty-free right to use that feedback without restriction or compensation. Do not include confidential information in feedback.

The website uses or links to third-party services, including Calendly, Vercel, and Fontshare. Your use of a third-party service may be governed by that provider's terms and privacy notice. Gladius does not control and is not responsible for third-party content, availability, security, or practices.
Disclaimer

Gladius disclaims implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. Gladius does not warrant that the website will be uninterrupted, error-free, secure, or free of harmful components. Limitation of liability
To the fullest extent permitted by law, Gladius and its personnel will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenue, data, goodwill, or business opportunity arising from or related to the website. Gladius's aggregate liability arising from the website will not exceed one hundred United States dollars. These limits do not apply where liability cannot lawfully be limited.
Indemnity
To the extent permitted by law, you agree to defend, indemnify, and hold harmless Gladius and its personnel from claims, damages, losses, liabilities, and reasonable costs arising from your unlawful use of the website, your violation of these terms, or your infringement of another person's rights.
Governing law
These terms are governed by the laws of California, without regard to conflict-of-law rules. Subject to applicable law, disputes relating to the website will be brought in the state or federal courts located in San Diego County, California. Nothing in these terms removes protections that cannot be waived under applicable law.
